Welcome to Fun With Faces ("we," "our," or "us"). By accessing or using our website and services at www.funwithfaces.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

1. Service Description

Fun With Faces provides an online platform that allows users to:

• Upload photographs
• Create custom face posters using AI-powered background removal
• Add custom text and styling to posters
• Download high-resolution poster files in PDF format

2. Account Registration

To download posters, you must create an account by providing:

• A valid email address
• A secure password
• Optional: Your full name

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

3. User Content and Intellectual Property

3.1 Your Content

You retain all rights to the photographs and content you upload ("Your Content"). By uploading content to our Service, you represent and warrant that:

• You own or have the necessary rights to use the photographs
• Your Content does not violate any third-party rights (including copyright, trademark, privacy, or publicity rights)
• Your Content does not contain illegal, harmful, or offensive material

3.2 License to Us

You grant us a limited, non-exclusive, royalty-free license to:

• Process and display Your Content for the purpose of providing the Service
• Store Your Content temporarily for service functionality
• Use anonymized, non-identifiable examples for marketing purposes (with your explicit consent)

3.3 Our Intellectual Property

The Service, including all software, designs, text, graphics, and other content (excluding Your Content), is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our software or content
• Reverse engineer or attempt to extract source code
• Remove or alter any copyright or proprietary notices

4. Pricing and Payment

4.1 Free Services

You may create unlimited posters for free. No payment is required to use the poster creation features.

4.2 Paid Services

To download high-resolution posters, you must purchase either:

• Pay-Per-Download: $2.99 per poster download
• Monthly Subscription: $9.99/month for unlimited downloads
• Annual Subscription: $79/year for unlimited downloads

4.3 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information. By making a purchase, you agree to Stripe's Terms of Service.

4.4 Subscriptions

• Subscriptions automatically renew unless canceled
• You may cancel at any time from your account settings
• Cancellations take effect at the end of the current billing period
• No refunds for partial months or unused downloads

5. Refund Policy

5.1 Pay-Per-Download Refunds

We offer refunds for individual poster downloads within 7 days if:

• The download failed due to a technical error on our end
• The poster quality is significantly defective due to our Service
• You accidentally purchased the same poster twice

Refunds will NOT be issued for:

• User error (wrong photo uploaded, typos in text, etc.)
• Dissatisfaction with the final result after successful download
• Change of mind after downloading

5.2 Subscription Refunds

• Monthly subscriptions: Refundable within 48 hours of initial purchase if no downloads have been made
• Annual subscriptions: Refundable within 14 days of initial purchase if fewer than 5 downloads have been made
• No refunds for renewals or partial periods

5.3 Requesting a Refund

To request a refund, contact us at mail@funwithfaces.com with:

• Your account email
• Transaction ID or date
• Reason for refund request

Refunds are processed within 5-10 business days.

6. Prohibited Uses

You agree NOT to use the Service to:

• Upload content that violates any law or regulation
• Upload content that infringes on third-party rights
• Upload content depicting minors without parental consent
• Upload offensive, defamatory, or harmful content
• Attempt to hack, disrupt, or compromise the Service
• Use automated tools (bots, scrapers) without permission
• Resell or redistribute our Service
• Create posters for illegal purposes

7. Content Moderation

We reserve the right to:

• Review uploaded content for compliance with these Terms
• Remove content that violates these Terms
• Suspend or terminate accounts that violate these Terms
• Report illegal content to law enforcement

8. Data Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results will meet your expectations
• Defects will be corrected
• The Service is free from viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption
• Damages resulting from unauthorized access to your account

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fun With Faces, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content

12. Copyright Infringement (DMCA)

We respect intellectual property rights. If you believe your copyrighted work has been infringed, please contact us at:

13. Termination

13.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Your account is inactive for more than 2 years
• We discontinue the Service

13.3 Effect of Termination

• Your right to use the Service immediately ceases
• We may delete your account and content
• Unused credits or subscription time are non-refundable
• Sections of these Terms that should survive termination will remain in effect

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending an email to your registered email address (for significant changes)

Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a claim, you agree to contact us at mail@funwithfaces.com to attempt to resolve the dispute informally.

15.2 Arbitration

Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall take place in Sumner County, Tennessee.

15.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Tennessee, United States, without regard to its conflict of law provisions.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

17.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms. We may assign these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
